The regulations from Article 15 of the EDI regulation on food information (LIV) (817.022.16) become mandatory from 1st of February 2025 and affect bread and pastries intended to be sold not pre-packed or offered for immediate eating. Customers must be informed in a written form about the manufacturing country of these products.
The obligation to state the country of production affects all companies that market or offer bread or pastries, including bakeries and market stalls, but also gas stations, takeaways, food trucks, kebab shops and others. Restaurants and hotels that offer bread and other baked goods at the breakfast buffet or in combination with any meal are also affected by this regulation, as well as communal catering in school canteens or cafeterias.
The written information of the country of production can be waived if the country of manufacture of the bread or baked goods is clearly visible to the consumers. This is guaranteed if an indication of the country of manufacture is provided in accordance with Art. 48b des Markenschutzgesetzes (SR 232.11) and inform about the country of origin in that way.
Note regarding the terminology of “country of production”: For prepared dough or dough pieces that have been produced in one country and are then finished by baking in another country, the country of dough manufacturing is considered as country of production, and not the country in which the dough pieces become the final product. The declaration obligation applies to bread, bread slices and all baked goods, including Croissants, Gipfeli, Weggli, hazelnut rolls and similar products.
Important to know:
- Long-life bakery products with a shelf life of more than 30 days are excluded from the obligation to indicate the country of origin.
- The regulation does not apply to bread after further processing or bread that is used to make other dishes. For this reason, dishes with further processed bread such as apple charlotte, bread soufflé or dishes with croutons or breadcrumbs are not affected.
- The corresponding information about the country of origin on bread and pastries intended to be sold not pre-packed or offered for immediate eating can be provided in clearly visible notice.
